Welcome to HampsteadGuitarLessons.com (“we,” “us,” or “our”), owned and operated by Hampstead Guitar, LLC. These Terms of Service (“Terms”) govern your access to and use of the website located at hampsteadguitarlessons.com, including all content, features, and services available through it (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
1. About the Services
Hampstead Guitar Lessons provides private, in-person music instruction at our studio located in Hampstead, Maryland. The Services include private lessons on guitar, ukulele, banjo, and bass for students of all ages and skill levels. Lessons are held weekly on a regularly scheduled day and time reserved for each student. The website also provides supplemental educational resources, lesson-related materials, scheduling information, a student calendar, and lesson policy information in support of the in-studio instruction.
2. Eligibility
Students of all ages are welcome. If you are under eighteen (18) years of age, your parent or legal guardian must consent to these Terms on your behalf and is responsible for your use of the Services and any obligations arising from the student-instructor relationship. By enrolling a minor, the parent or legal guardian agrees to be bound by these Terms. By using the Services, you represent and warrant that you are authorized to agree to these Terms, either on your own behalf or on behalf of a minor student.
3. Enrollment and Lesson Policies
3.1 Enrollment
Enrollment is on a first-come, first-served basis and is subject to availability. Students may enroll at any time. Upon enrollment, a regular weekly lesson time will be reserved for the student. Lesson duration options include 30-minute, 45-minute, and 60-minute sessions.
3.2 Lesson Policy
All students and parents are expected to review and comply with our Lesson Policy, which is available on the website. The Lesson Policy addresses attendance expectations, cancellation and rescheduling procedures, makeup lesson provisions, and other studio guidelines. The Lesson Policy is incorporated into these Terms by reference. Regular attendance is important both for student progress and the functioning of the studio.
3.3 Cancellation and Rescheduling
Cancellation and rescheduling of individual lessons are subject to the terms outlined in the Lesson Policy. Failure to provide adequate notice of cancellation as specified in the Lesson Policy may result in forfeiture of that lesson. Students wishing to discontinue lessons entirely should provide notice as specified in the Lesson Policy.
4. Tuition and Payment
4.1 Tuition Rates
Tuition is charged on a monthly basis at the rates published on the Pricing page of the website. All prices are quoted in U.S. dollars. Tuition rates are subject to change with reasonable advance notice.
4.2 Payment Terms
Monthly tuition is due at the beginning of each month or as otherwise agreed upon at the time of enrollment. Payment methods accepted will be communicated at the time of enrollment. Late payments may result in suspension of lessons until payment is received. Continued enrollment is contingent upon current payment status.
4.3 Refunds
Tuition payments are generally non-refundable. Refund eligibility, if any, will be addressed on a case-by-case basis in accordance with the Lesson Policy.
5. Studio Conduct and Safety
Students and their accompanying parents or guardians are expected to conduct themselves in a respectful and courteous manner while at the studio. Students should arrive on time for their scheduled lessons. Parents or guardians of minor students are responsible for ensuring timely drop-off and pick-up. Hampstead Guitar, LLC is not responsible for the supervision of students outside of their scheduled lesson time. Any behavior that disrupts the learning environment or poses a safety concern may result in termination of enrollment.
6. Assumption of Risk and Physical Activity
Playing a musical instrument involves physical activity including repetitive hand and finger motions. You acknowledge that participation in music lessons carries inherent risks of physical strain or discomfort. Students are encouraged to practice safely, take breaks as needed, and notify the instructor of any pain or discomfort. Hampstead Guitar, LLC is not liable for any injury sustained during or as a result of music instruction or practice. If you have a pre-existing medical condition that may affect your ability to play, please consult a healthcare professional.
7. Intellectual Property
7.1 Ownership
All content available through the website, including but not limited to lesson materials, worksheets, tablature, chord and lyric sheets, written content, audio and video recordings, graphics, and website design, is the property of Hampstead Guitar, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you under these Terms are reserved.
7.2 Permitted Use
Lesson materials provided to students, including worksheets, tablature, and other handouts, are for the student’s personal educational use only. You may not reproduce, distribute, publicly display, or exploit these materials for any commercial purpose or share them with individuals who are not enrolled students without prior written consent.
7.3 Recording
Audio or video recording of lessons is permitted only with the prior consent of the instructor and is for the student’s personal study use only. Recordings may not be shared, distributed, uploaded, or published in any form without the prior written consent of Jim Ellis.
8. Website Content and YouTube
The website may feature embedded YouTube videos, including lesson demonstrations and play-along content. This content is provided for educational and informational purposes. Your interaction with embedded YouTube content is subject to YouTube’s own terms of service and privacy policies. We are not responsible for the availability or content of third-party platforms.
9. Privacy
We respect your privacy and are committed to protecting your personal information. Personal information collected in connection with enrollment and the Services is used solely for the purpose of providing music instruction and related communications. 10. Third-Party Services and Links
The website may contain links to third-party websites or utilize third-party services for scheduling, payment processing, video content, or other functions. Your use of any third-party service is subject to that service’s own terms and privacy policies. We are not responsible for the content, availability, or practices of any third-party service.
11. Disclaimer of Warranties
THE SERVICES AND THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAMPSTEAD GUITAR, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY SPECIFIC EDUCATIONAL OUTCOMES, MUSICAL PROFICIENCY, OR SKILL LEVEL AS A RESULT OF USING THE SERVICES. MUSICAL DEVELOPMENT DEPENDS ON MANY FACTORS INCLUDING INDIVIDUAL EFFORT, PRACTICE, AND NATURAL ABILITY.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAMPSTEAD GUITAR, LLC, ITS OWNER, AFFILIATES, INSTRUCTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, THE WEBSITE, OR PARTICIPATION IN MUSIC LESSONS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID TO HAMPSTEAD GUITAR, LLC IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Hampstead Guitar, LLC, its owner, affiliates, instructors, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use or misuse of the Services or the website, (b) your or your student’s participation in music lessons, (c) your violation of these Terms, or (d) your violation of any third party’s rights.
14. Termination
Either party may terminate the student-instructor relationship at any time, subject to the notice requirements outlined in the Lesson Policy. Upon termination, the student’s reserved lesson time will be released and access to any student-only areas of the website may be revoked. Provisions of these Terms that by their nature should survive termination shall remain in effect.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Carroll County, Maryland, or the United States District Court for the District of Maryland.
16. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will update the “Last Updated” date at the top of these Terms. Your continued use of the Services after any changes become effective constitutes your acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
18. Entire Agreement
These Terms, together with the Lesson Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Hampstead Guitar, LLC regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
